सात अगस्त १९०५ को ‘विदेशी वस्तुओं के बहिष्कार ‘ का आंदोलन प्रारम्भ हुआ था इसलिए आगामी ७ अगस्त को अंगेजी सरकार द्वारा बनाये गए उन २२२ क़ानूनी प्रावधानों की होली जलाई जाएगी जो आज भी देश में लागू हैं। यह जानकारी सर्वोच्च न्यायालय के वरिष्ठ अधिवक्ता अश्विनी उपाध्याय ने दी। वे लगभग दो दशक से ‘भारत के स्वदेशी संविधान ‘ के लिए आंदोलन चला रहे हैं।
उनके द्वारा जनहित याचिकाएं किये जाने के बाद भारतीय संसद ने लगभग ८० अनावश्यक कानूनी प्रावधानों को निरस्त किया है।वे हिन्दुओं को उन राज्यों में अल्पसंख्यक का दर्जा दिलवाने के लिए मुखर हैं जहाँ उनकी जनसँख्या कम है। इस वर्ष फरवरी में ऐसे ही अनेक कानूनी प्रावधानों को हटवाने के लिए दिल्ली के जंतर -मंतर में श्री उपाध्याय को उनके अनेक समर्थकों के साथ गिरफ्तार किया गया था।
बतचीत में उन्होने कहा – ‘ कानून घटिया है इसलिए भगवान श्रीराम और श्रीकृष्ण समेत हिन्दू देवी -देवताओं का मजाक उड़ाने वाले ,प्रधानमंत्री की बोटी- बोटी काटने की धमकी देने वाले छुट्टा घूम रहे हैं।
इतना ही नहीं ,करोड़ों का कालाधन बेनामी संपत्ति आय से अधिक संपत्ति रखने वाला विधाएक -सांसद आदि बन रहा है जबकि ऐसा अमेरिका जैसे कथित उदारवादी देश में होता तो ऐसे लोग जेल में होते। हमारे देश में हमारी सभ्यता -संस्कृति और जीवन दर्शन के अनुरूप संविधान की आवश्यकता है। ‘
‘सूचना का अधिकार ‘ और जनहित याचिकाएं दायर करने में अग्रणी श्री उपाध्याय ने पिछले दिनों सर्वोच्च न्यायालय के दो न्यायाधीशों द्वारा की गयी अनर्गल टिप्पणी के विरुद्ध आवाज बुलंद करते हुए कहा था कि न्याय में देरी और न्याय प्रक्रिया के लगातार महंगे होते जाने के कारण भी अनेक लोग आत्महत्या के लिए विवश हैं। इसमें सुधार के लिए उन्होने पूरे देश में घूम-घूम कर जनजागृति अभियान प्रारम्भ किया है जिसमें विषय होते हैं – जज क्यों बेलगाम हैं? , न्याय क्यों बिक रहा है? , ज्यूडिशियल रिफार्म कैसे होगा? , ज्यूडिशियल चार्टर क्यों जरूरी है? , तारीख पे तारीख क्यों मिल रही है? , न्याय में देरी के लिए कौन है जिम्मेदार?, कोर्ट के कारण कितना कालाधन बनता है? , न्यायपालिका के कारण कितने लोग परेशान हैं? , न्याय में देरी से कितने लोग आत्महत्या करते हैं?
एक प्रश्न के लिखित उत्तर में उन्होने बताया कि आगामी आठ अगस्त को भारतीय जीवन के विधानों के विपरीत उन २२२ कानूनों को समाप्त कराने के लिए निम्नलिखित कानूनों की होली जलाई जाएगी -:
